Arizona closing and recording

What is a deed of trust?

Arizona law defines a deed of trust as a conveyance to a trustee that secures performance of a contract. [S1] If your refinance uses a deed of trust, it is the security document for the loan.

What about transfer taxes and document fees?

Arizona's constitution prohibits new taxes, fees and stamp requirements on transfers of real-property interests, with an exception for charges already in existence on December 31, 2007. [S5] That provision is not a blanket waiver of document fees.

Arizona exempts transfers solely to provide or release debt security from the affidavit-of-legal-value requirement and its related fee. The document must state the reason for that exemption. [S2] This is a specific exemption, not a promise that recording is free: Arizona law separately provides for county recorder fees. [S3]

Ask your closing team to identify the security document, any separate ownership-transfer documents and the recording entries on your Loan Estimate.

How it works

  1. Check your options. Seeing them takes about 30 seconds and uses a soft credit inquiry — no impact to your credit score. A hard pull comes later, with a full application.
  2. See your numbers. Your options on screen, in plain figures, before you commit to anything.
  3. Close fully online. The whole process runs digitally, from application through closing.
